I am thankful to kanye west for letting Taylor swift finish her speech! The 52nd Annual Grammy Awards is now running and CBS is broadcasting the event, taking place at Staples Center in Los Angeles, California. Neil Young was honored as the 2010 MusiCares Person of the Year on January 29, two days prior to the Grammy telecast.

Beyoncé leads the nominees with ten nominations. Other nominees include Taylor Swift with eight and Black Eyed Peas, Maxwell, Kanye West with six nominations, and David Guetta, Jay-Z and Lady Gaga with five nominations. Colbie Caillat, Kings of Leon, Bruce Springsteen, T-Pain, and Keith Urban each received four nominations.

PRC November 2009 Nursing Licensure Board Exam Results

Im happy to hear that the result of the Philippine (NLE) Nursing Licensure (Board) Examination, which was held in Manila & all Regional Offices on November 29 & 30, 2009 has been released by the PRC.

A total of 37, 527 out of 94,462 (39.73%) nursing graduates passed the November, 2009 licensure examination.

The examination was given by the Board of Nursing in the cities of Manila, Baguio, Butuan, Cagayan de Oro, Cebu, Davao, Iloilo, La Union, Legazpi, Lucena, Pagadian, Pampanga, Sulu, Tacloban, Tuguegarao and Zamboanga last November 2009.

The oathtaking ceremony of the successful examinees in the said examination in Manila as well as the previous ones who have not taken their Oath of Professional will be held before the Board on Monday and Tuesday, March 8 and 9, 2010, with morning (8:00 A.M.) and afternoon (1:00 P.M.) sessions at the SMX Convention Center, SM Mall of Asia, Pasay City. All must come in their white gala uniform, nurse’s cap, white duty shoes, without earrings, hair not touching the collar and without corsage.

The Professional Regulation Commission reminded those who will register are required to bring the following: duly accomplished Oath Form or Panunumpa ng Propesyonal, current Community Tax Certificate (cedula), 2 pieces passport size picture (colored with white background and complete name tag), 1 piece 1” x 1” picture (colored with white background and complete name tag), 2 sets of metered documentary stamps, and 1 short brown envelope with name and profession; and to pay the Initial Registration Fee of P600 and Annual Registration Fee of P450 for 2010-2013. Successful examinees should personally register and sign in the Roster of Registered Professionals.

Oathtaking tickets for the National Capital Region (NCR) and nearby regions will be available at the Philippine Nurses Association (PNA) at 1663 F.T. Benitez Street, Malate, Manila, starting Monday, February 8, 2010 on a “first come first serve” basis.

According to Presidential deputy spokesman Gary Olivar, Remonde was found unconcious on his bathroom. Bubut Velasco, head exec asst of OPS confirms Remonde being revived at Makati Med. My friend Maidee also confirms arrival of Sec Remonde at the Makati Med.

Maintain Fealty to the Rule of Law:
Let the Next President to Appoint the Next Chief Justice

Statement of Members of the Faculty
January 18, 2010

Essential to the existence of a democratic republic is its fealty to the Rule of Law. Any attempt to circumvent clear constitutional text must be justified on grounds of absolute necessity. The need to fill in a lacuna in constitutional text through interpretation must be made on the basis of real needs and not imagined scenarios.

We, the members of the UP College of Law Faculty, are of the firm conviction that the incumbent President cannot appoint the next Chief Justice when the present Chief Justice Reynato Puno retires on May 17, 2010. We do not see any reason why the constitutional provision for the President not to issue any “midnight appointment” in the twilight of her term should not be followed.

The President’s appointing power is limited by an express provision in article VII, section 15 of the Constitution, to wit:

Sec. 15. Two months immediately before the next presidential elections and up to the end of his term, a President or Acting President shall not make appointments, except temporary appointments to executive positions when continued vacancies therein will prejudice public service or endanger public safety.

This provision proscribes any “midnight” appointment made by the incumbent President of the Republic starting from March 10, 2010 to June 30, 2010. This prohibition was conceived to prevent the scandalous actuations of two past administrations whose acts had to be rectified by Supreme Court decisions.

The only exception is to make “temporary appointments” and only for “executive positions”. Even this exception is qualified by the phrase “when continued vacancies…will prejudice public service or endanger public safety.”

The position of Chief Justice is not an executive position. The appointment of a Chief Justice is not a temporary appointment. Whoever is appointed sits until her/his retirement at the age of 70 years old or sooner upon her/his resignation. The retirement of Chief Justice Puno, on the eve of May 17, 2010, is well within the period of the constitutional ban on appointment. The clearest textual reading of the Constitution is that the incumbent President cannot appoint the next chief justice.

It has been suggested that the absence of a Chief Justice might trigger a constitutional crises because it is the Chief Justice that presides over the Presidential Electoral Tribunal and that s/he presides over the entire Supreme Court.

This argument is pure speculation in the light of settled practice that an Acting Chief Justice may be appointed from among the incumbent justices of the Supreme Court. The Supreme Court also does not cease to function simply because it has less than fifteen justices.

The appointment of a permanent Chief Justice by the incumbent President causes more concern. She has appointed all 14 of the other justices of the Supreme Court. If the sitting Chief Justice will be her appointee, the maintenance of the independence of the judiciary may be seriously jeopardized.

It is also argued that the Constitution requires that any vacancy in the Supreme Court must be filled within a period of ninety days. This is not clear from the second paragraph of section 9, article VIII of the Constitution. Even assuming but without conceding this to be true, the next President will have until August 15, 2010 or a month and a half to select the next associate justice. A month and a half is also sufficient time to reflect on who can be chosen as the next Chief Justice. All presidential candidates must by now be considering their own choices of who might become Chief Justice. The Chief Justice is traditionally chosen from among the most senior justices of the Supreme Court.

We therefore find no overriding, logical and imminent reason that would require that the plain meaning of the Constitution as ratified by our people be violated. There are more serious repercussions to the rule of law as well as the independence of the judiciary if the Judicial and Bar Council transmits a list of nominees for the Chief Justice and if the incumbent President actually makes an appointment. It is this threatened unconstitutional act that will cause a true constitutional crises.

Thus we, members of the faculty of the UP College of Law,

(1) Urge the Judicial and Bar Council not to transmit the names of the nominees for the position of Chief Justice until after a new President shall have assumed office on June 30, 2010;

(2) call on the incumbent President to exercise restraint for the sake of judicial independence and respect for the Rule of Law and therefore refrain from appointing the next Chief Justice; and

(3) call on our colleagues in various law faculties, law students and our alumni to make their voices be heard on this very important issue.

LATEST NEWS ON LOCAL TV: ANOTHER SUSPENSION FOR SHOWTIME’S REPLACEMENT, MAGPASIKAT!

MANILA, Philippines – “Magpasikat,” an ABS-CBN talent show that temporarily replaced “Showtime,” is also in danger of being suspended.

The Movie and Television Review and Classification Board (MTRCB) insisted on Thursday that “Magpasikat” and “Showtime” “are one and the same show,” thus, the replacement should also go off the air.

The MTRCB made this statement during its preliminary hearing on the remarks made by Rosanna Roces on “Showtime” that resulted in the 20-day suspension of the show.

“‘Yong suspension ng ‘Showtime Live’ ay i-extend doon sa ‘Magpasikat Live’ because they’re one and the same, ” said lawyer Jonathan Presquito, MTRCB’s legal counsel.

Before the suspension order can be issued, however, the hearing committee quickly clarified that this will still be investigated.

“We will see. Aalamin pa ng committee kung totoo nga,” said lawyer Paulino Cases Jr., head of the hearing committee.

Nonetheless, the statement of the MTRCB has caught the Kapamilya network by surprise.

“The MTRCB says that supposing the hearing is on a certain subject and suddenly we are surprised that the prosecution brings up an all together different subject,” lawyer Miguel Silos, ABS-CBN’s legal counsel, said.

During the preliminary hearing, the committee was initially scheduled to investigate Roces’ remarks that were directed at Vice Ganda in “Showtime’s” January 4 episode. But the MTRCB also brought up Roces’ January 7 controversial remarks that have been criticized by many as insults to school teachers.

The Kapamilya network lamented that the MTRCB kept issuing orders without due process.

ABS-CBN lawyer Maxim Uy added: "Ang basehan nitong mosyon ng MTRCB ay ang sabi nila dahil pareho daw ang mga hosts at bukod din doon pareho ang mga production staff. Siguro naman ho alam natin na hindi dahil pareho ang mga host at pareho ang production staff, ang ibig sabihin ay pareho na ang programa."

ABS-CBN Corporate Communications head Bong Osorio also complained that the board seemed to be targeting ABS-CBN shows being aired on the noontime slot.

“Parang wala na silang gustong ABS-CBN program na ipalabas sa timeslot na yan. Ano kaya ang meron sa timeslot na yan at napag-iinitan?” he said.

PSPC STATEMENT ON THE REVERSAL OF BIR’S RULING ON CCG

Pilipinas Shell Petroleum Corporation expressed concern at reports that Bureau of Internal Revenue (BIR) Commissioner Joel Tan-Torres has reversed the 2004 BIR Memorandum that held that Shell’s importation of Catalytic Cracked Gasoline (CCG) and Light Catalytic Cracked Gasoline (LCCG) raw materials are not subject to excise taxes.

The BIR reversal came soon after Shell filed a case with the Court of Tax Appeals (CTA) questioning the jurisdiction of the Bureau of Customs (BOC) to collect P7.3 Billion for its alleged tax deficiency on the importation of CCG and LCCG. Shell asserts that since excise taxes are internal revenue taxes, it is the BIR and not the BoC that has jurisdiction over the same.

The latest BIR position abandons the series of rulings issued since 2004 exempting from excise taxes all importations of raw materials used by Shell to produce unleaded premium gasoline. BIR Commissioner Jose Mario Buñag previously ruled that CCG and LCCG are “not finished gasoline products intended for use by end consumers” and are not subject to excise tax upon importation. This position was also affirmed by BIR Commissioner Guillermo Parayno. In a Memorandum issued in June 2009, former BIR Commissioner Sixto Esquivias IV reiterated these prior rulings confirming that CCG and LCCG are not subject to excise tax.

The 2004 BIR ruling was uniformly implemented by several BIR Commissioners and the BOC including the current BOC Commissioner Napoleon Morales when he was the Batangas Port Collector.

The BIR reversal also runs counter to 4 settled rulings of the Supreme Court on the matter, the first ruling having been established 80 years ago in the 1929 Asiatic Petroleum case, reiterated by the high court in the Petron and SilkAir cases decided in 2008 where it held that excise tax is not imposed on the act of importation but is levied on the consumption of specified products.

The latest BIR position likewise contradicts findings of the Department of Energy (DOE), the agency which has specialized expertise in this issue, in 2003 and 2009 that imported CCG and LCCG are raw materials used by Shell for the production of unleaded gasoline.

Newly appointed BIR Commissioner Joel Tan-Torres explained the sudden reversal by claiming that factual findings of the BOC which were previously not disclosed or given by Shell provide basis for reversing the previous BIR position. In response, Shell cites a 2009 BOC investigation report that found no evidence that Shell was selling CCG and LCCG to the public to refute the claim of misrepresentation. Furthermore, Commissioner Tan-Torres’ claims of misrepresentations have already been previously considered and rejected by former BIR Commissioner Esquivias when he issued his Memorandum in June 2009 upholding Shell’s position.

Shell also maintains that while it does not pay excise taxes to the BOC when CCG/LCCG is imported, it has paid billions in corresponding excise taxes after the imported CCG and LCCG have been processed into unleaded gasoline and withdrawn from its Batangas refinery.

Even the BOC Verification Committee Reports of August 17, 2009 and November 11, 2009 recognized the unjustness of the double taxation when it recommended that Shell should be allowed to credit any excise taxes paid on its imports by deducting it from the excise taxes due when it withdraws its finished products from its refinery. However, Commissioner Tan Torres does not provide for the crediting system when he reversed the 2004 BIR Memorandum which effectively results in double taxation. Note that finished product importers pay excise taxes on entry to BOC but do not pay excise taxes to the BIR when the product is withdrawn from their import facilities for sale to the market.

The BOC had intended to seize US$400 Million worth of future importations by Shell to enforce the disputed assessment but Shell filed a case before the Court of Tax Appeals (CTA) earlier this month to dispute the assessment and, last December 09, the CTA issued a 60-day temporary restraining order barring the BOC from implementing the seizures.

“The BIR and BOC should not resort to unlawful double taxation as this implies that we are discouraging manufacturing in the country and putting at risk the supply security of our energy requirements. The threatened seizures will also result in work stoppage in the Shell refinery and a nationwide fuel shortage,” Edgar Chua, PSPC Chairman and President said.

PSPC will continue to seek legal remedies to contest the recent BIR ruling.

“Beyond the immediate impact to our economy, this reversal of the BIR results in an unpredictable regulatory environment that sends a negative signal to investors. We are hopeful that this matter will be resolved soon,” Chua added.
